Of course it's copyright protected. The creator of the DVD decides what the terms for copying the DVD are. It's no more legal to copy and resell this DVD than Star Wars..
The only difference here is that they did not buy into the standards of the big studios, and lock the DVD so it could only be played on their approved DVD players. Since it is not CSS scrambled, it can be played on any Linux system, without need to use the de-CSS software.
Good point. I was just reproducing the summary that Wired News supplied to my RSS reader--a summary that glossed over an important distinction.
